App Stores To Require Privacy Policies

Both Google and Apple responded to multi-pronged assaults on the privacy policy gap in mobile apps yesterday (Feb. 23) by agreeing to abide by California’s Online Privacy Protection Act and require privacy policies in apps within their stores that collect personal data. California Attorney General Kamala Harris had been pressing the companies to follow these legal guidelines, which had been in place for her state for nine years. Google, Apple, Amazon, Microsoft and Hewlett Packard all signed a joint deal that would require developers to post a privacy policy within their apps when collecting personally identifiable information. “PII” includes any information that allows a user to be contacted directly, including name, email or physical address, phone number.

The move comes a week after the Federal Trade commission issued an unambiguous critique of the lax approach to privacy within the mobile app ecosystem. The FTC found that apps aimed at children were negligent in following basic legal guidelines for getting permission from parents before collecting data from children and from clarifying what kinds of data was being collected and for what purpose.

The agreement only touches on a much larger issue that has emerged of late around how apps collect sometimes sensitive information from phones, including personal address books and location. Many apps in the social networking sphere will scan a user’s contact list on their phone to find the user’s friends who are already in the social network.
